Crypto regulation
In Spain the CNMV is the competent authority for CASPs (exchange, custody, trading) while Banco de España supervises stablecoins (ART/EMT); the designation derives from Ley 6/2023 (LMVSI). The transition period for VASPs already registered with Banco de España ends 1 July 2026.
Taxation
Residents' crypto gains fall into the savings tax base with a progressive scale: 19% up to €6,000, 21% up to €50,000, 23% up to €200,000, 27% up to €300,000 and 30% above. There is no crypto-specific tax-free threshold, and crypto-to-crypto swaps are taxable events (permuta).
Useful information
Crypto held abroad must be declared via Modelo 721 if it exceeds €50,000 at 31 December; resident exchanges file Modelos 172/173. Crypto is included in the Wealth Tax and the Solidarity Tax on Large Fortunes (above the exempt minimum, usually €700,000).
